The "secondary search" is the dog sniff. I'm pretty sure most dog handlers wont inform anyone what the dog's response is supposed to be to a positive hit on something. (the response was probably the dog sitting down or maybe barking. Most of the time it's a silent response like sitting) That's probably why they wouldnt tell the guy what the dog did. They dont want people to know what the animal responses are.

Dogs are not infallible anyways. I had my luggage searched when coming back from England because the dog indicated there was a problem. (nothing was there. Only thing I had that the dog could have hit on might have been the 20 pounds of Cadbury's chocolate I had. I had no problem with being searched as long as there wasnt any dog drool in my chocolate)


I dont understand why he wouldnt let them search the car. If he didnt have anything illegal in the car, why refuse? That just makes the police more suspicious. I'd have let them do the search. I dont see the harm in letting them do their job.

If he wasn't trying to hide anything why did he refuse to answer their questions?

I become immediately suspicious of anyone who uses their religious position to try and convince anyone of their innocence.

How many children were molested by Catholic priests? Didnt a young girl just get murdered by a church worker? How many book burnings have gone on in the name of religion?

So, IF he was allowed into the country, and free pass without having to submit to simple questions like "are you bringing in illegal items to our country?" or "are you hiding refugees in the trunk?" then of course he would be on youtube talking about how slack security is at the borders. He seems a bit cocky, and a smarty pants, and I too would want him stopped for further questions.

All I know is you don't mess with the border patrol. If you have nothing to hide just get out and do what they say. I'd like to see what prompted the beating to be honest. Makes me wonder if he resisted or something. Beating him like that is not right but those people have a hard job to do and they don't need resistance.

He's enjoying his fifteen minutes of fame. Probably looking to make some $$ off of it.

that guy, pastor or not, had every right to not cooperate in that search at that time. Just because the border patrol "said" a dog had signaled suspicion does not mean it actually happened.

Clearly, from the pastor's point of view, he was being unjustly detained.

The incident smacks of a police state action. He was not guilty just because he refused to submit.

It is similar to incidences at the airport. Remember the woman with a child's sippy cup? Being arrested as she tried to show a patrol woman that there was only water in the cup?

The border patrol was WAY out of line. For goodness sakes, we have Sheriff Joe Arpaio here.

I agree with both sides, he should have cooperated and he should not have been abused for not cooperating, but I have to admit, after hearing his u-tube bit, I felt like smacking him myself..

If they had to smash his windows to reach in and pull him out of the car, he must have refused their orders for him to get out of the car. The doors were probably locked, otherwise they could just open the drivers door and yank him out, so I'd say that refusing to get out of the car could be considered "resisting".

Just listening to the way he explained things, I think there's something hinky in his story. I'd love to see the video of what happened, and see for myself what really went on. Just because he's a pastor, doesnt mean that he's above reproach.

Yes, he has the right to invoke the Fourth Amendment, but when a law enforcement officer asks you to get out of the car, you get out of the car.

Getting out of the car wont give them permission to get in the car and search it, but refusing to follow orders to get out of the car can possibly give them probable cause to search the car without a warrant.

I doubt he's going to get any legal repercussions from it, the judge will probably tell him to follow the orders of law enforcement officers next time, and will send him on his way. An expensive lesson, two car windows and a trip to the emergicare for 11 stitches probably costs a lot. Painful too. Getting tazed is not fun. (ask me how I know )

I think he got his 8 minutes of fame. He should have followed the orders. You don't mess with the law.

If he was tazed as many times as it seems he was saying, I think he would have gone in his pants to say the least. Or it would/could have killed him. Once could probably make him go. I doubt that he could hold it at all.

He kept saying how they smashed his face into the pavement and glass. I didn't see anything else but the stuff on his forehead. If he was beat up and his face forced into the pavement, it seems to me that his whole face would be a mess.

Perhaps he just thinks that he doesn't have to follow orders when it comes to those checkpoints. And just because he is pastor doesn't mean that he couldn't have had drugs or warm bodies in his vehicle. After all, that's what the law is looking for. IDK
