Sandy, I am not sure of the entire history, but attorneys do not charge to consult and they can figure out the best thing. In my daughters case she had injury at one employer and escalation at second employer.
She ahd two cases, what we should have done was filed dual at one time... But, I guess it was fastest to take the first employer whre she had a claim open an they stopped benefits to go with that and reopen. So we did. The second case the judge was from the first case and he dedcided just having TOS would get worse, even if she did not work. BUT the contention was she had TOS, and functioned in the job a year, then new symptoms, CT and zingers happened. There were massive spasms across the traps and she was going to the pain doc for trigger points every other week to get through the work day. She was working in a major bread distrabution center. It got bad when her coworker went on maternity leave and the tons of data and all the massive phone calls coming in were taken care of by her. She cradled the phone on her TOS side shoulder and WHAM she was never to gain control over the symptoms they snow balled. Glad you got the avatar thing figured out, Di

Hi, I love your avitar, it is adorable. Just my 2 cents, but I think a good lawyer is in order here. Like Di said, you can have a free consult. It could determine how your case goes, they have more experience with your situation. We do not really know the entire story. Please take the time to ask around and see a good attorney.
