I know this isn't the WC forum but many here suffer from the inhumane treatment allowed in the system. I will post on the WC forum, I just posted it here for those who don't visit that forum........Hope

Workers were allowed to sue their employers only if negligence could be proved. Employers were concerned about their liability, not all of which was covered 100% by their liability insurance leaving them vulnerable to civil lawsuits and large payouts. These problems eventually led to passage of the Boynton Act in 1913 that provided for an integrated system that required employers to have safety programs and provide for compensation for workers injured in the course of employment. This "no fault"system is often referred to as the "historic bargain"between employers and workers: Workers gave up the right to sue their employers in civil court for work injuries in exchange for an administrative system that provided prompt medical treatment and compensation. Later on, the bargain was preserved in the California Constitution. Here's what it says: "California Constitution, Article XIV, Section 4 VotersInjuredatWork.org is dedicated to preserving the rights and benefits that are guaranteed under the California Constitution, Article XIV, Section 4. ....................... SEC. 4. The Legislature is hereby expressly vested with plenary power, unlimited by any provision of this Constitution, to create, and enforce a complete system of workers' compensation, by appropriate legislation, and in that behalf to create and enforce a liability on the part of any or all persons to compensate any or all of their workers for injury or disability, Then end result was the virtually unanimous approval of what is the worst workers' compensation bill in the 90 year history of workers' compensation in California. there were a few drops of water on the floor in the bathroom at work. i slipped and fell. it really wasn't that bad physically but mentally i was really hurting because i didn't know at first it wasn't going to be that bad.
my trip to the emergency room was quite unimpressive. even though i have a healed over fractured vertebrae (that no one caught when it happened) they didn't think it was necessary to x-ray my back, even though i complained of back pain in the same spot where my fracture was. my ankle, which was turning pretty colors, they did not even bother to x-ray (or look at) at all, so i had to get that done later. my family doctor was not jazzed. anyway, 3 days later another gal fell in the same bathroom. only this time, instead of a few drops there was a big puddle from a leak in the roof. the thing that hurt me the most about the injury, was that some people came up to me and asked me if i was glad that the other gal fell, because it vindicated me. (translation - they didn't believe that my fall was a genuine accident until someone else had it happen). some people just don't get it. |

Everyone in CA. Please!!!
I urge you to visit the Votersinjuredatwork.org site if you were injured on the job!! I tried to post that site on the other TOS forum and had my threads closed. This organization is made up of INJURED WORKERS like ourselves that are trying to help us get our rightfully deserved benefits!!! They will e-mail you updates whether you join their organization or not!! They can tell you about their latest efforts to get us back our benefits that have been slashed by Governor Schwarzenegger; including his recent veto of SB815 that would have reinstated permanent disability benefits!!! Please, please, please !! Visit this site !! Encourage family and friends to visit this site !! They may be in our shoes some day !! Ask them to participate in rallys and protests in our place if they are able to !! Thanks All, And Thanks Hope for bringing up a very important topic!!! G~ |

I'll post this on Gromily's thread too because I want all (esp those in Ca) to see how they are laughing at us all the way to the bank.
Worker's Comp is a joke! I hope you can pull up this article - we are about to vote for a new govenor.
