I'm so very sorry about what's happening to you. You may not remember me but I joined the old forum in 2003, so am not unfamiliar with your story and the discomfort you've been through, and for so long. Just want you to know I'm thinking of you too.
Also, thanks for alerting us and keeping us posted when Martha was having her asthma incident. All the best. phoebe |

Oh Hope I am insensed! I will be happy to rant and rave for you. I negotiate for a living so let me at em.
And let me know if you need any letter writing. I am there. I am happy that you are having the procedure tomorrow and hope that it brings you relief. I will keep you in my thoughts and prayers. |

What they've done to you stinks with a capital "S". It really did aggravate me when I read your first post but I'm glad to see that you're going to be able to go ahead with the surgery afterall. I hope this works for you and puts a stop to your pain. Best wishes! |

Am coming across your post kind of late, so not sure if you'll see this or not....but just want to wish you the best of luck tomorrow! I hope the procedure goes smoothly and that you get lots of relief--I know you've waited for this for a long time.

As of recent, I too am having problems with one of my ins. co.s.
I have no money to immediately plunk down for an insurance plaintiff's attorney, so here's what I did. First job, get the policy and all "addendums" (fiance calls it something else, but I call them addendums. Very important. They can fully change or eliminate a term that might have been against you.) Then, read the policy with a highlighter, every word. In my case, they were totally wrong, by term, and by their factual amount. Total idiots. So I drafted a letter which apprised them of the area of the policy I read, and my caculations, and the facts of my particular case. They have reinstated part of the problem, and are "appealing" the second part. Now I wait. Maybe 30 - 60 days - I made sure I got my appeal in within my insurance policy's 30 day limit, so this do-it-yourself is not without it's risks to myself. If it doesn't go my way, then I'm going to have to pull together $5K probably as a retainer to sue them in regular civil court as it is not a w/c issue. An analysis of what's at stake justifies the retainer. I know NOTHING about insurance bad faith law, so that makes my self-representation now quite risky. My point is, that everyone has a right to get their policie(s) and addenda when requested. Hope, you and I have talked about this so much, I really can't post here what I think about your attorney, but I do know the w/c court HAS jurisdiction over your ins. co. - your w/c company, that is. So now if you go for surgery, are you going to have to be rehabbed and then P&Sd again? This is how cases become years long - we are not simple knee surgery and back to work cases - and we need attorneys in CA who are willing to do unpaid Expedited Hearings. (There is a way they could be paid, but they are not used to using a fee motion procedure, which in bankruptcy it is used constantly. It's all a mess, thanks to that new law which was passed, which gave the insurance co.'s more time to get a final Utilization Review for ANY surgical / invasive procedure, and that means more wait-time for us. That law did nothing for us as workers, in my opinion.) |

Has anyone talked to Hope since her procedure? I hope everything is OK and that she'll let us know how she is soon or will let one of you who have contact with her let us know how she is. It sounds like she's really been through h%@$ the last few years and I hope she's pain free now.
