I was in a car accident on 2/20, suffering still from PCS.
My insurance company told me early on that I was entitled to wage reimbursement, 75% in MA. I was also told if the employer allowed "buyback" of my vacation and sick time, I could use that time so that there was no lag in my pay, the employer would get paid for my time, and it would revert back to "unused" status. My employer is telling me that since the insurance company is only paying them 75%, I only get 75% of my sick and vacation time back. Does anyone know if that's how it works? I don't feel well enough yet to work full days, and by the end of this week all my sick and vacation time will be exhausted. I know I will get 75% wage reimbursement through PIP, but my employer is all concerned about the "work that is not getting done" because I am not yet full time. Does anyone know if I can now be made to use my sick and vacation time up? |
