Default North Carolina

Hi, Dejibo,

Here are the criteria for involuntary hospitalization in North Carolina:

http://www.aoc.state.nc.us/magistrat...ents/index.htm

==========
Chapter 122C of the North Carolina General Statutes requires that the respondent be mentally ill and a danger to himself or others or in need of treatment in order to prevent further disability or deterioration that would predictably result in dangerousness.

Definitions
"Dangerous to himself" means that within the relevant past the respondent has

acted in such a way as to show that he would be unable, without care, supervision, and the continued assistance of others not otherwise available, to exercise self-control, judgment, and discretion in the conduct of his daily responsibilities and social relations, or to satisfy his need for nourishment, personal or medical care, shelter, or self-protection and safety; and that there is a reasonable probability of his suffering serious physical debilitation within the near future unless adequate treatment is given. (A showing of behavior that is grossly irrational, of actions that the individual is unable to control, of behavior that is grossly inappropriate to the situation, or of other evidence of severely impaired insight and judgment creates a prima facie inference that the individual is unable to care for himself)

or

The individual has attempted suicide or threatened suicide and that there is a reasonable probability of suicide unless adequate treatment is given or
The individual has mutilated himself or attempted to mutilate himself and that there is a reasonable probability of serious self-mutilation unless adequate treatment is given.

"Dangerous to others" means that within the relevant past, the individual has inflicted or attempted to inflict or threatened to inflict serious bodily harm on another, or has acted in such a way as to create a substantial risk of serious bodily harm to another, or has engaged in extreme destruction of property; and that there is a reasonable probability that this conduct will be repeated. NCGS 122C-3(11)(B)

You need to talk to an MD, Social Worker, or lawyer not associated with Social Services.

Well, my mother is being abused. I think that is my business! my niece slips further and further away each year. That IS my business!
Your mother deserves better but as long as she refuses to ask for help for herself she makes it difficult. Does your mother have an MD that she would talk to?

IF and thats a big if my mother decides to end this, how would she get this unmotivated girl some help? I advised her to go to the ER and speak to them about her. DONT let her represent herself as she will lie. Tell them the truth and that she CANNOT come back to your house when they are done. Hopefully social services will put her in a half way house. My mom has told me several times she is at that point.
Your mother can call Social Services herself and tell them the truth.

You cannot motivate the niece unless you have the cooperation of your mother. You CAN motivate your mother. Keep talking to her.

In North Carolina where she lives, she would simply have to be presented at any emergency room by a blood relative and they would put her on a 72 hour hold for observation. This includes but is not limited to suicidal, depression, bi-polar flares, unstable mood disorders, and a whole host of other issues. I even had the social worker tell me that if the family reaches that point simply take her to the ER and DONT allow her to speak for herself. YOU be the one to tell the admitting nurse or triage what is happening then ask to speak to the admitting MD in charge of the ER or mental health unit before you leave her. She will have 72 hours to defend herself and tell all the stories she wishes.

it would break my heart for that to happen to her. I think there are so many things that can be done for her NOW! without forcing her away from her home, or having her family throw her into a hospital. She needs someone with a strong set of family rules, and house rules, and someone to cheer lead and motivate her. She needs to be removed from the internet games, and brought into THIS reality. She needs support, and love and encouragement, not just a line of folks biding their time till they can get rid of her or throw her into the hospital.

Spoke to her mom AND her dad. Both said "she is almost 30 years old let her figure it out for herself." I asked if she could live with either of them. both said NO! she ruined our house, and caused such stress that im sorry to say we were thrilled when she left. she cant EVER come live with us again." I asked if they would please get more involved in her life and help her find some stability. and both said "let the old woman figure it out, she is her problem now." I asked "what happens when the old woman dies, or has to be committed to a nursing home? and was told "I would drive her to the first ER we passed and drop her off." UGH!

so, you can see im paddling fast, but getting no where. I think I have no choice but to do as they ask and back off. it wrecks me, but I have MS, and the stress isnt helping me either.
