Thank you ladies. Love to you today (((HUGS)))

I would like to get out of the house for a little while today- by myself. I may just head out to the grocery store because there are a few things I will need soon, and I'm out of ice cream

I'm going to get my blood drawn tomorrow morning. I will make sure I'm really well hydrated because my surgeon thinks that my eGFR was so low and my creatinine was so high because I was dehydrated the last time I had labs done. I hope she's right. It usually takes no more than 3 days for test results to come back, so my surgeon should have the results by the time she is back in her suburban office on Friday... as long as my PCP faxes the results to her.

I called the leasing office today to tell them about Ellen's fight with the woman in the car on Saturday night. I spoke to the manager, George, and asked him if Janet told him about Thursday. He said yes, and he had spoken to Ellen. His excuses about the situation in general were:
1) These things are happening before "quiet hours" (which should NOT matter)
2) "Ellen's been around forever, and nobody else has ever complained."

My answers were:
!) It should NOT matter when they are making this noise. Why don't you come over and spend the weekend, and see if you would want to live below them?
2) Nobody else complains because she's friends with everyone else in the building
3) They were not like this when we first moved in. They have gotten progressively worse- probably because they are drinking and drugging more
4) We never bother anyone, and pay our rent on time every month
5) We lived on the 1st floor at our old place for 7 1/2 yrs and never had a problem with our numerous upstairs neighbors (high rent increases every year)
6) Even tho we have only been here for a year, we have rights, too
7) You can say something to them again, and they will be quite for a while, but they will be back to their bad behavior again before long, and the cycle will continue

He asked me what I wanted him to do about it, and I said ideally, we want to move to a different apartment, but I have surgery coming up, so it's not the best time. He said he would be on the look-out for another vacancy, and would speak to Ellen again.

Whatever.
I think calling the office may be more stressful than the upstairs neighbors. I'm tired of listening to the office staff defend those a/h's and make me feel like a liar.
Corey is going to go ape s- when I tell him.

Unhappy

I think you stated your story as best as you could.
Glad that you gave him the heads up about possibly moving.
If it is after hours then call the police next time they have a party.
just my opinion.

Out of curiosity when is it considered out of hours.

I would want to make sure I know that.
And maybe you could start taping what is going on. So he can
hear the commotion.

In our little town their is an 9pm I believe time period that noise
is considered an nuisance and if you mow after that or anything
else you get visited by the cops.

I know some get called on at 7pm, and the cops show up too.

But that is a little early to me. Unless its really a problem.

ANd this is houses not apartments.

I guess "Quiet Hours" are different depending on when people moved in and signed their leases. I know my next door neighbor Mary's lease says 10pm-10am tho. The only thing in my lease says no moving in/out or moving furniture until after 7am, so everything is vastly different lol.

There is a highlighted section in our lease that states that you will not be a nuisance to your neighbors, and doesn't mention any time of day, but it goes on to sate what kind of disruptions qualify. It is a safety net for landlords to protect them from the "The Right To Quiet Enjoyment" law, where it also doesn't matter what time of day the incidents are happening. That highlighted section is in the lease so the landlord can warn/evict bad tenants so people who are effected won't sue them if they can't control the offenders.

When I said I wanted to move, I meant I wanted George to move us to another apartment in this complex, and it sounds like he is willing to do that. The apartments here are nice, and that way, we wouldn't have to pay first, last, and security again someplace else because we can't afford it right now.

I told Corey that we just have to look forward to moving. The problem is I'll be having major surgery soon, I don't know when it will be, and I don't know when I'll be up for packing. Obviously, I won't be actually moving anything.

My anxiety has been better for the last few days despite all the BS going on, but...

I took 1 1/2 mg of Klonopin yesterday morning for my anxiety, which isn't that unusual, but after I got off the phone with George, I had to take another 1/2mg:
1) It's very unusual for me to take 2mg of Klonopin in a day, and
2) I usually avoid taking any Klonopin in the afternoon because of sedation

At least my anxiety is responding to the Klonopin, so I know I'm not experiencing agitation. I woke up with significant anxiety this morning and didn't mess around with just taking my usual 1mg and waiting to see if I needed more. I knew I would need more, so I took 1 1/2mg. That was enough, and I feel much better.

In the future, I will be submitting my complaints in writing to avoid spikes in my anxiety like this. My last contact with the office will fade soon, and my anxiety should come back down soon, too.

None of my anxiety has to do with the surgery. I'm looking forward to getting it over with. I'm waiting for someone to call me this week to discuss a date for the surgery.
