I am sooooooooooooooooooooooooooooo upset, I got there, then the advocate and me, and the messenger/server guy (to serve him his Order of Protection) we waited.....

Finally 9am, I had to go in court, no husband.....***** of a woman judge.

It has been postponed she said because his lawyer/public defender whatever hasn't had a chance to get the police report and get together to discuss the case!!!! Whattttttttttttttttttttttttttttttttttttttttttttttt ttttt this has been over 3 wks since the first time we went to court.

So, I came home all upset, I am now going to press charges myself and get a lawyer through Legal Assistance, meeting with my DV case mgr tomorrow to get it going.

He is stalling, because he knows he is in the wrong. I now have his address the court got it for me to give to the messenger or server, and I am waiting for the messenger to call me, that he got him served, it's 6:15pm and he works till 6pm and where he lives is right around the corner.

The judge was very mean, I said I wasn't notified of this delay, she said either was I till I got here. I spoke about him being served, she said well then the messenger isn't doing his job right. OMG Then I asked if I could approach the bench and give her some papers. She said NO you have to give everything to the prosecutor. I was treated like a criminal, not a victim.

I took meds as soon as I made my phone calls to my p-doc case mgr, dv case mgr, and my PCP, I just lost it.....etc. and slept. I was just so upset.

The next court date is Oct. 16th at 3pm.........................................Happy birthday to me, since my stinking birthday is the 11th of Oct.

I don't know how much more of his crap I can take. So, now I am going to press charges against him and get legal aide help public defender or whatever I need to do. I have had it with him!!!!!!!!!!!!!!!!

I wasted money on parking, I put the damn 4 dollars in the wrong parking spot, so I had to put a 5 dollar bill in the correct one I was parked in.
It costs me gas to get downtown.

Well, I have calmed down some, but I am not feeling good at all. So, that's the story of today. Once again he wins. well for now anyway.

wasn't the original order of protection to last until his court date - yet it wasn't postponed with the court-date??? jerks. well i hope that messenger gets through.

i'm glad your case mgr can work with you on pressing charges yourself. i hope the situation can be expedited that way... anyway they will know.

heck. this just sucks. i'm glad you got some sleep after that ordeal.

nikko, i am so sorry this all happening to you.

what is happening in the courts is very typical. his attorney doesn't want there to be any trace of a bruise on you. they want you to look fit and healthy when in court. take as many pictures daily as you can. make sure the pictures are dated.

keep track of every penny you spend. if he does get convicted, there are victims funds to help reimburrse you. the money comes from whatever job he is given in prison. ( yes they do work and are paid a wage to go into their victims funds)

Hi, and Thanks...........................Waves the Order of Protection that the Judge ordered for my husband to stay away from me, is only good until the case is over. So, that is why I got my own Order of Protection that will be good for 1 year. I didn't get a call that he was served last night, so I will call at 8am. I feel my husband knows they are trying to serve him by now, since they tried 2x at his job, I assume he must think they are divorce papers, so I don't understand why he is avoiding them. He wouldn't think that I got my own Order of Protection, since there is one in place. I went through this before when I tried to serve him, finally they had to serve him at my lawyers back East.

Curious - the police took pictures at the scene. Of me and his PC that he smashed all over. That is why there are 2 charges, ASSAULT on me and AGGRAVATED CRIMINAL DAMAGE that is him smashing his PC. My medical problems are all documented from my PCP, they are all about my c-spine neck fusion and my post concussion syndrome, that is why I am having a MRI of my spine on Monday, and another Cat Scan of my brain right afterwards with contrast/dye. Plus the ER documentation.

The only thing I had was my knee was cut up from the fall, and the police bandaged that, then later my right eye turned purple on the lid. Besides my head was pounding, I was dazed and my neck hurt. It should all be in the police report, which I should get ASAP, since now I am pressing charges.

So, they have to go by the documentation from my PCP or by the time we go to court for the 3rd time, I should have the results of those tests.

Plus, hopefully the prior's of DV I printed out from back East.

My appt, is at 12:30, so that's my time, I am on Mountain time, so I will be on later to let you know what happens next. It's just I am so friggin drained, and in pain, then fatigued and the pain meds too, at least they make me rest as I am supposed to be doing.

I know he is buying time, it's so obvious, you would think he would want to get this over, itstead of hanging over his head.
