What kind of results have you had in Workers Compensation cases where Fibromyalgia has been the issue?

From my understanding...I could be mistaken -
For wc you have to be able to prove that something at work caused the injury or condition. Was there any type of injury before the Fibromyalgia occurred? Do you have a firm diagnosis of Fibromyalgia and possibly with a few drs agreeing? Does your dr believe your job caused the Fibromyalgia and can /will he be able to explain how & why? like possibly - chemicals, repetitive injuries, other - I'm not sure what else may cause Fibromyalgia... Another thing that might come up - were you healthy before the fibro occurred or have you had misc health issues in the past - these might have lead up to the Fibromyalgia. We do have a Work comp forum ( http://neurotalk.psychcentral.com/forum30.html ) as well as Disability forum ( http://neurotalk.psychcentral.com/forum28.html ) - both of those might be helpful with tips on best ways to proceed in the various "systems".

I have had fibromyalgia for many years. In 2005 I applied for Social Security Disability (SSDI)because I could not keep working. I was declined immediately, which is the standard. But do not give up. I hired an attorney who got the benefits awarded retroactive to the date I left work. Her fee was nominal. It is not welfare......we pay into our social security account with every paycheck. Don't wait, assuming that the fibromyalgia will go away. If it does, and you are able to return to work, you can discontinue the SSDI. I was 56 years old when I started to collect my benefits. Waiting another 8 years to collect social security was not an option. So, keep trying even if you are declined. Best of luck.

Thank you both. I actually was injured at work-I hurt my neck and I ended up with 3 bulging discs, C4-C7 and developed post trauma fibromyalgia from that.
I was recently approved for SSDI-it came through about a month after I applied and had 1 year back pay with it. The application was long and drawn out and took me about a week to complete, but after that it was easy. There was no hearing or anything. |
