Default Has anyone received a settlement with their lifetime medical?

I have lifetime medical from my work injury with two big companies! One company is willing to settle but the other is not! They have to both be willing to settle or nothing happens! They say it has something to do with CA and medicare making it difficult! I'm not asking for much like my pain doc says but they are so cheap! Now they want me to take generic meds and my favorite dr. in the whole world says they are not the same! Sure hope to get a settlement with them on my lifetime medical sooner than later! Just another chronic pain patient from a work injury! Love this group! J P

I haven't settled yet, but I'm in CA. My attorney tells me that clients they've had for 20 years with open Lifetime Med, are now being turned down for meds they've been all those years.

My guess is that since the latest changes in WC law, the insurance companies don't have the same incentive to settle since they're paying out so much less in benefits.

If there is a chance of you needing to apply for SSI or SSDI, any Medical Settlement proposal should be submitted to Medicare for approval of a Set Aside Account which can delay things.
