Default Lifetime medical after work comp injury

My question is how to get my attorney to continue working for me when I have 2 lifetime medical benefits and I'm not receiving the care I need. Travelers is one and they sent a 5 page letter turning down the medication and treatment I need as a chronic pain patient! I keep calling my attorney's office with no action as yet! Any advice?

You probably should get new attorney. I don't know all of your circumstsnces but you might inquire if complait to the state bar assoc is in order aganist your current attorney

Default Hi Brachial

I know about another gent in SNY who is having issues with WC also. Keeps getting turned down for needed care. His lawyer appears to drag his feet as well. I think I would go confront the attorney, ask outright if he intends to go forward to help you. If you don't get a good answer and assurance, head for the door and a new attorney. You do need someone in your corner. The other case I know about is a neck injury which needs surgery. His doc. said yes, WC said no. I don't understand how WC can determine what care you get. ginnie

Default Hi Don

Yes, you found one of the people I told you about. They too are having WC problems. I just wish the WC folks would do the right thing for people without a huge battle. You already know I am praying for you and others with this issue. Thanks brother....xginnie

Default I received lifetime medical from two companies!

As an update: I have received lifetime medical from two big companies now I am trying to get my WC Attorney to see if they will both settle with me with a fair settlement if that is possible. Has anyone done this? Thanks for any feedback!

im not sure how each state works (or for that matter your case or attorney)but.with my it was just settle with work man comp, lifetime med and that was it.but i guess again it depends on your case, attorney and state.not sure why these 2 different groups are involved

You will likely have to pay your attorney for additional time if the case was more or less "settled."

I would contact the state insurance commissioner if i was having issues with getting benefits.

I'm still waiting one company willing to settle but not the other! They both have to agree to settle the lifetime medical! I have heard it is all about money and those companies want the cheapest way out!

I am new to this community but have had now 4 years dealing with w.c. My case is slightly different as the w.c. carrier is so large that it is self-insured AND they claim, it is the largest? or nearly largest? senior healthcare provider in the U.S. They have been relentlessly abusive and my "attorney" has run like a scared rabbit in the wake of their power and influence. NO ONE will take the case and I am in danger of being "BUTCHERED" as they are being allowed to doctor-shop me until they can find someone who will sell out to them and say there is nothing wrong with me. NO law in my state helps the injured and the size of the company that caused this is too big...they advertise on television constantly! If they would just do the right thing and help me it would only cost them about 1 day of national advertising but they would rather spend all of their money to prove that this is a fraud rather than helping be sure that I get whatever care the doctor orders. My "attorney" made a deal that was EXTREMELY POSITIVE for them and even made a joke about me being "nuts" so they would not agree to any type of counseling. It was more than a year before they would take financial responsibility and when they found that the case manager was being kind to me, they fired her! A woman with 25 years experience and a heart for the hurting lost her job because of this huge, senior healthcare provider. It is terrifying to think how they treat the residents who are put, helpless, into their "care". If I am ANY INDICATION of how they treat people they can control when no one is watching, we should all be VERY, VERY CONCERNED. Thanks for caring enough to listen.
