After meeting with the doctor in person, can always say, you'd like to get a second opinion.

if a confirmation is made from a spinal Dr. that the spine is the cause ofr all of my symptoms would it be possible to take legal action against:
diagnosing Dr, second opinion Dr, and new Dr after i moved? i was sent to UCLA for confirmation of Dx and she just gave me balance and strength tests. i later moved and needed a new Dr and she just went along with the DX. i had Brain MRI's in 2008, 2011, and 2013.. NONE of the reports showed lesions.. the 2011 report actually states: MRI OF THE HEAD WITHOUT ENHANCEMENT: TECHNIQUE: Multiplanar, multisequence imaging of the brain was obtained. 20 cc of gadolinium contrast material injected. HISTORY: Multiple sclerosis. FINDINGS: The ventricles are normal in size and position with no hydrocephalus identified. FLAIR weighted images reveal tiny area of increased signal intensity in the subcortical white matter of the right posterior frontal parietal region. This is nonspecific. It is not classic for multiple sclerosis; however, demyelinating disease is not completely excluded. Similar findings can be seen in patients with migraine headaches or can be related to other benign etiologies. No other areas of altered signal are identified involving the brain. No areas of abnormal enhancement are identified involving the brain. Within the posterior fossa no abnormality of the brainstem or cerebellum is identified. Normal flow-void is noted within both internal carotid arteries and basilar artery. There is a moderate amount of fluid within the right mastoid. There is some artifact in the left facial region around the left maxillary sinus. IMPRESSION: 1. FLAIR weighted images reveal a tiny area of increased signal intensity within the subcortical white matter of the right posterior frontal parietal region which is nonspecific in a patient of this age. No abnormalities of the brain are identified. 2. Moderate amount of fluid within the right mastoid. |

That description of the increased signal intensity in the subcortical white matter is how a radiologist will typically describe what we all refer to as lesions. My reports are very similar to yours in that there are a number of possible causes for the enhanced signal on the MRI, and they arrive at an MS Dx usually based on descriptions of symptoms, and the results of other testing that rules out other possible causes.
My question is why do you think you have a cause of action against the Dr and why do you need financial redress for it? Do you think the doctors deliberately mis Dxed you? Did you lose alot of money because you were Dxed? MS and other non-specific disorders are extremely hard to Dx and the testing required to rule things in or out can be very expensive. So the docs have to balance the cost and time and trouble to the patient of doing more tests against the value of ruling out one more possible thing. If all of your symptoms are leading the doctor towards MS, and the MRI shows a possible lesion, it is not unreasonable for them to lean towards that Dx, and to shy away from doing other expensive tests that might not give them any information they didn't already have. Until there is a yes or no test for MS, there will be times when the doctors are wrong. Just because they are wrong, doesn't mean they were guilty of malpractice. If they make the best Dx based on the info they have and it is wrong...it is just wrong...not malpractice. Not directing this at you entirely, but if people want to have lower medical costs, a great place to start is accepting that doctors are not infallible, and when they are wrong, it isn't always cause for a lawsuit. Ok, sorry, off my soapbox now... |

as of August 1st, i will have had the DX 5 years ago.. that means 5 years of not knowing my future. as you know ms Can be VERY bad the longEr you have it.. i have not had much cost with the DX.. some Copaxone and MRI's, but where the real distress has been is mentally not knowing my future.. if indeed the Cervial is causing most of this, i could have it dealt with 5 years ago. |
