Won on 3 counts with BOLI filing!
Hi Everyone,
Wishing you all a Happy New Year! Unfortunately I started mine out a little shaky. Had a minor injury at work that turned into a major flare thruout my body. Amazing how a simple bruise can turn into a major pain! Continue to battle for ergonomic accomodations recommended by my physical therapist and my employers own ergonomic specialist request on my behalf for accommodations at work to no availe. They are demanding that I sign a Hippa release, releasing all my medical records for the next 5 years. Of course I refused! I did however win on 3 counts on my first filing with BOLI. This is good news. Employer was found guilty of 1. Not entering into the accommodation process, 2. Breaking the ADA laws by not accommodating my disability, & 3. Retaliation. Suppose to be in negotiation process but they are choosing to ignore any attempt so far. All of this makes an already stressful job 100 times more stressful. Just dealing with the RSD is stressful enough. Not sure how long I can hang on to my job. It's a battle for sure, but got to survive and keep my medical insurance and a roof over my head. Swimming has been one of the best things for me keeping mobile. I've read the temp. needs to be 86 degrees. I was born and grew up in Eugene, Or. Used to love to snow ski, but those days are gone. Eugene is where I got RSD, following breast tumor surgery-benign. I wasn't diagnosed for 4 years, while living here in AZ. I'm so sorry you are struggling with the red tape that wraps itself around the work system etc. I hope you are able to keep your job. I've lost the ability to engage in sports, and as for work, I don't do well engaging in the business, as my memory is not reliable. I try, but need to be monitored. I actually flew back to Eugene to see a hand ortho sports injury group and he diagnosed me within a minute. The Dr. here in AZ said rheumatoid arthritis, but I knew that wasn't correct.
