Question about WC and Returning to Work
 
I have a question. If one takes leave to file a WC claim, and is denied then the appeal is denied, can one return to their original place of work?

Would a denied claim, leave one suspect to perform the job that they were doing? Would the employer ask them to not return to work?

Anyone have any experiences with a denied WC claim and a return to work?

You can double check on your state website for more specific WC info.
But generally an employer can not discriminate against anyone that has filed a WC claim.

I had repetitive use claims over 15 years w/same employer, for my wrists, shoulders and neck. I always had excellent reviews, and never felt any discrimination at all.
I had some accepted claims and some denied, with most I did recover in the time frame and w/ PT & some light duty. Until that last time, now a chronic condition.

But some less than reputable companies may try to squeeze someone out if they also have poor performance or poor attendance on reviews/record.

Thanks. I'm just worried about a coworker, coming back. Everyone tries to pull their fair share. It's tough to modify that type of workplace. I was curious, if denied, if she could come back.

Depends on if she has any job limitations/restrictions written by drs, and if the company can or will make a job for her that complies with any limitations..

Much depends on the size of the business too, small companies usually have less options for modified work.
I worked in different departments when on modified duty, my employer had 500 employees so there was room for me to help out in other places.
I filled in as receptionist, security patrol, office clerk, filing, shipping and misc helper.
