When you get a settlement from workers comp and you are on SSD; what exactly happens? I was receiving both (WC benefits & a small offset). I received a small settlement from workers comp & my medicare benefits and cash benefits were stopped. And now they want $2,086.00 for a medicare payment. I called & I asked them if I am entitled to SSD benefits since I received a settlement; They said they don't know they are working on it & it's in Baltimore. I don't understand. Can anyone here give me any info? Thanks.

SSDI or SSI ?
It can depend on what state you live in as to how WC settlements are managed. Did the WC settlement include lifetime medical ? I've heard that there is a way that WC settlements can be written so it is considered as they are paid out over a period of years, not income added to one year, that can help people keep SSDI coverage and MC. Unfortunately, I'm not sure how that works. Did you use a lawyer for either your SSDI or WC claim ? The more information that you can provide here, the more helpful it might be to our more knowledgable posters who might be able to help you. |
