sorry ginnie if this sounds "annoying"just trying to help.but what about some of the politicians in your area like a "Senator"or "congressPerson".i was told by some member here to try.since i have new info on my shoulder.well you know they now found i have 2disc problem in my neck after the "EMG"(remember).this may help my case.when i resubmitt this.but this time to my "CongressPerson"or "Senator"

The Gov. did not care what my trust said. I was not allowed to have it and when I just had medicare, I was responsible for the 20%. Hence all money was used up. It is a horrible situation. ginnie thank you for this venting space, I am going nuts with this
Here is some information on trusts. If you scroll down about halfway there are links to the Social Security Act. Maybe you can print these out and give them to the attorney.

Did you tell them you have to pay your son back? If you click income it says they don't count SSI for the following reasons.

loans to you (cash or in–kind) that you have to repay;

That's why I asked ginnie. It's unclear from your posts exactly how all of this went down (and that certainly could be because the Medicaid/foodstamp decision was a weird one), so I was wondering if you had committed the blunder of having those tax funds temporarily in your possession.

If your son mailed the check directly to the town/state for the taxes, I don't understand why your foodstamps were denied....that makes no sense to me.

The link works for me too, but it is about setting up trusrs for SSI recipients and has NOTHING to do with food stamps.

Ginnie, It sounds like a very complicated situation, and the unusual trust conditions with home ownership are involved, I sure hope your lawyer is a good one.
He/she will have to review the documents and really understand them and they decide the best way to move forward for you.

I'm guessing that since there was and outstanding tax balance due on the home, the food stamps were denied.
I don't know if that is the usual way of doing things.
Unless they are wanting you to forfeit the home...


you may need a trust lawyer as well if the other one is mainly a SSDI/SSI atty.

So my backpay is being held up while they decide if I qualify for SSI or not.

Meanwhile, I am getting "FINAL!" notices concerning SSI, saying I need to call them.

I have called every day for over a week and only get this woman's answering machine. I always leave a message, and they never call back. >(

Unhappy frustrated as usual

My son paid the check directly to the Tax agency. The trust had been in both our names, however I never had access to the account with out my son. I could never use it without his permission. When the money ran out, only the house remains in the trust. Sean paid out of his pocket for the taxes. I also had to perform the rules of the trust to give out to the beneficiaries what was due them, my son and daughter. I completed this last year with the last distribution of the trusts money. I was required by The trusts laws to do this. Medicare required that I pay the 20% of what I owed to medical problems, or I would loose my coverage altogether. It did not matter to the government that I was not allowed to use trust money for my medical conditions. That trust was for my taxes. I was forced to use it, and only then was I allowed medicaid, and food stamps. I went to my local church and had their attorney look at this trust to make sure I was doing all the right things according to the trust and for my government. I was penalized for having the dang thing before, and now I am being penalized for not having the money for taxes. They made me use it up before I got help with medicaid.This home I live in is in the trust. I cannot move, or I forfeit the house to both of my children. Being forced out of my paid for home to me is stupid, as if I leave it, federal housing would have to be found, or I will be homeless. The government would have to pay even more to keep me as a disabled person. The trust was written by someone who had no knowledge of medicaid, medicare, dcf, or SSID or any other agency. He was ignorant and did a terrible thing to me.ginnie I am trapped between two oppossing forces, my trust, and the government.
