If my husband at age 42 is to win his case for SSDI. How much would our children get a month? Some told me 200 per child, others told me they recived as high as 450 a month. Is that state by state? Both of our children are under 16.

Hi, they do not have a "per child" rate. Whatever his check is your children will cumulatively receive half. For example, if his check is $1,500/mo then your kids would get $750. It doesn't matter if you have 1 or 50 kids, the amount will be the same.

SSDI is federal so it doesn't matter what state you live in. |

Not all claims result in benefits to children. Depends on the earnings record. If the worker had just barely enough credits, their benefit may equal the family maximum. Or the family maximum may only allow for a very small amount paid to the children with the maximum not exceeding 1/2 of the benefit to the worker. |

Thanks to all for the info. Will I ( the wife ) be able to collect anything? The crazy thing is, I asked these questions to the 800# and each rep gives me a totally different answer. And our local office is worse!

But you will be dividing the family pie into more pieces. The pie doesn't bigger. You probably get different answers because you ask different questions. The claims rep at your local office or the claims authorizer at the payment center is the person who will be making the decisions about who gets what Sometimes these computations are so complicated that it is difficult to provide an estimate. |

From my understanding of it, Until, you could get a piece of the family benefit if you care for a child of the SSDI recipient (so instead of 2 kids splitting 50/50 the maximum of 50% of hubby's benefit, you and 2 kids would each get 1/3) Frequently, the spouse of the SSDI recipient is in a higher tax bracket than their kids so they choose to just keep the split between the kids.
I've really only heard of ex spouses of the SSDI recipient wanting it divided that way
