Default SSI and Living Arrangements question

Hi all ,
Have a question about ssi living arrangements .
My representative payee called SSA back in June 2008 about me being able to prepare my own meals which I am required to report since I live in NY . The problem is SSA never imputed the change and told my rep that since I live with other people he can never be considered a live-alone even if he pays his own share of expenses. After doing some research it seems I should have been put in an A federal SSi living arrangement and a NY state ssi living arrangement of A (not B ) which would of got me the live-alone SSI benefit which is more than my current benefit . What can I do to try to recover the money owed to me if anything . My rep says it has to be in the system that he called to report the change .

Oh ! and I also would like to know if I can keep my medicaid while I work if I still receive an ssi check . Do i have to do a medicaid buy-in if I still receive an SSI check while working ?

Any help is most appreciated !

Not all phone calls are logged in to any system. So it is not true that an alleged report 4 years ago will be 'in the system'.

There are also limits on reopening incorrect decisions for SSI. Two years is the limit and that is only if there is new and material evidence.

I am not impressed with your representative payee. Allegedly makes a phone call, doesn't provide proof and then does nothing to follow up for four years? Does he he write checks to the people you live with to pay for your share of household expenses? Or does the money come in and he gives it all to you and you decide how to spend it and you spend it all in cash with no paper trail? If he is not managing your money, what purpose does he serve? A conduit payee is not doing their job. Do you even need a payee? What does your treating doctor say about it?

Read about 1619a and 1619b benefits for the working SSI disabled. Here's a place to start http://www.socialsecurity.gov/ssi/sp...t-medicaid.htm

For payment, your gross wages are used, minus the $65 earned income exclusion divided by 2 is the countable amount, generally affects payment two months after receipt, including the 2nd month after you stop working.
