Sad day. Due to the length of my disability I have been let go. I still have workmans comp but no job when im better. I provided the health insurance. Bummer of a day.

Sorry to hear of your situation. Are you working on a Social Security Disability Insurance application?

What happened: I was randomly assaulted from behind in June of 2011. I was knocked unconscious for an unknown amount of time (less than 30 minutes) and have no memory of the event. CT scan showed contusion and hematoma of the left frontal lobe. I spent 3 days in the hospital. Diagnosed with Post-Concussion Syndrome in September 2011. Currently have Medicaid, Medicare and SSI. Current symptoms: Brain fog, mild memory issues, problems with spontaneity, occasional spacing out, word finding difficulties, tinnitus in right ear and some other things that I can't explain. Life after the brain injury: 4 years after the injury, I'm engaged to my beautiful girlfriend of 5 years, I'm the CEO of my own business, Notorious Labs, I've taught myself how to program complex games and apps which is a feat I never thought I'd accomplish and now live a semi-normal life with very mild PCS symptoms. Slowly but surely regaining my life back. |

I havent been working on ssi. My docs think I will get better and it takes time. I do have an atty. Should I? I heard I have to wait to reach a disability impairment rating. Im so confused by the whole process.

It would be worthwhile to get an SSDI application started. They will determine if you are disabled. They do not rely on what your doctor says.
Disability Impairment Ratings are used by the Work Comp claim system. SSDI does not consider any partial disabilities. They only consider how much money you can make working with your current limitations. They do require that it is expected that your current condition will last more than a year. At this point, you will be approaching 8 months by the time your application is into the process, with the normal delays expected. Considering your current condition, I would not bet against your condition lasting beyond one year. The Docs claim that you will recover has no bearing. The SSDI people will make their own determination. The process of applying will help you better understand your work capabilities. It also will give you something to move forward with. I am not trying to scare you about your prognosis. I am just suggesting the SSDI application 'just in case.' You can always stop the application process if you recover before getting approved. My best to you.

While we're on the subject of SSDI...
You said that they do not rely on what the doctors say...If that was true, I'm wondering why they sent a packet to my psychiatrist and neurologist to fill out. They called me to ask a question...and she told me she was waiting on them to send the stuff back before they made a decision.

It sure hurts when you loose your job. Sorry this happened. Yes do apply for SSDI. In my case as I lost my career also, I did seek the advice of an attorney. I had his assistant, who does nothing but these kinds of applications help me to apply for both SS and later SSDI. I wish you all the best. It is my understanding that when you have a legal representative, the process can go smoother. I wish you all the best. ginnie
