Default Dealings with the insurance company

any advice on handling the assessments ordered by the insurance company? These assessments delay my recovery, and do not provide any useful info about my injury. how did you handle them? Anyone would like to share experience? Please feel free to PM me.

What kind of insurance.. Medical? WC? Auto?

What tests are they ordering that you do not think are helpful?

The Start: MVA, t-boned, on 1-12-14 (my sons 5th birthday) and did not think anything of it.. my back hurt on site but everything else seemed ok. Lost about 10-12 hours from about 3 hours after the accident to the next day...Experienced terrible brain fog for over a month, plus intense headaches, nausea, dizziness, cognitive difficulties, disorientation, no short term memory, depression and just an overall hangover feeling daily.

Current Situation: I'm about 7 months in and my local neurologist has waived her white flag and therefore I am headed to Dallas to be seen (I have family there). The headaches are still daily. I have nausea, dizziness as well.

Drugs I have been on- Vicodin (off), Naproxen (off), proanolol (off), topamax (off), cataflam (off), Midrin (off), Flexeril (off) and now Namenda XR (off), Nortrptylin (off), Verapamil (off)

Therapy- Osteopath, Vestibular and balance therapy, fuzion/soft tissue massage, acupuncture

Drs- ER (no help), GP, Chiropractor, Neurologist and Osteopath

I don't understand how assessments can delay recovery. I can see how a NeuroPsych Assessment can cause a few days of fatigue but that's about it.

Will, is this YOUR insurer, ordering the neuro-psych in an attempt to cut you off from your schedule B benefits, or the other side, trying to weaken your schedule A case?

No insurer ordered test will EVER help you, medically or otherwise. If it's your own insurer, your lawyer may well advise you to decline the test, lose your benefits and pay out of pocket for your care, rather than take an unfair test that could compromise your schedule A action - and probably see you lose your Schedule B benefits, anyway.

If it's the other side, they have a legal right to examine you, so you can't avoid the test. Your lawyer, should, however, be getting a second neuro-psych by a truly unbiased clinician.

No doubt your lawyer will be familiar with the neuro-psychologist in question, and will be able to direct you accordingly.

It would be helpful if people would at least list the country they are in. That way, we can get a better understanding of the legal system they are under.

Hockey's would say, Somewhere in Canada.

In the US, the state would be good because WC is different state by state.

Yes, and insurance laws can vary from state to state and province to province. Nova Scotia, New Brunswick and Ontario (at least) are provinces with "caps." Heaven help MVA victims, in those places.
