Default My day Sucked

I do not like the outcome of my whole day. My husband can come back to the house so whoever is in it the other has to stay away. That is because of the protective order. On my lawyer's advice and knowing how partial the judge seems to be for Rook what I got seemed to be the only way. I will only be getting alimony for 3 years and then it will stop. The alimony is in place of the all the property settelement so I got screwed big time. The alimony will be all I will get, no property settlement at all since the property settlement will be paid in monthly payments called alimony. If I die tomorrow my husband wouldn't have to pay a penny. He was a real jerk and so was his lying lawyer.

Unhappy

This sounds so unfair....
can you file an appeal?
I really don't know what I am talking about there just seems to HAVE to be something that you can do to try to get this more in your interests.

If he comes back to the house, where will you go?
And what happened to his cat?

OMG - Is the house in both your names? This sounds awful. How can a judge do such a thing! How are you supposed to know when he is going to just walk in. If you have the Order of Protection against him, then he shouldn't be allowed anywhere near you. Did you tell the court that you are in fear of him?

I got my husband off the rental lease of this house.

So, is the house being sold then? Is this from the DV case or divorce proceedings? I am confused, what else is new.

Oh, I don't know what to say. APPEAL - sounds like a good idea, I know you want to move on and get this all behind you, but how can you even do that if he has access to the house whenever he damn pleases.

I guess moving is an option for you if you can afford to. Can you get a new lawyer? Can you call a womans shelter or get a court advocate to help you. In this state, if you feel you need to move, because of fear and DV cases, they will give you some money, not a lot, but some, as long as you have a place to go. Really, I have learned a lot from the womens center, they have so many options and helpful resourses out there, that I would of never known about.

This is all too much, I feel very badly for you. But hang in there, do you feel safe?

Please take care and keep posting.

Big Hugs, Nikko

Angry

((((((B)))))),

Sounds like you had the same lawyer I did

I found out much after the fact that the EX had threatened my lawyer so she went along with everything that "he" (EX) wanted. I got custody of the child with no house to live in

Bizi and Nikko are right -- talk to another lawyer. It sounds like you weren't fairly represented.

Of course, I don't know all the details of your sitch.

There's another solution, too -- which is the one I was forced to **LEARN** -- call it a REAL EXPENSIVE LESSON and move on. Even our kids said "he uses the house like a **** carrot -- trying to manipulate everyone to do what he wants". As long as you two own property together, the **** will continue. Soon as you get the house out of your reality, you'll get rid of him.

B, even if you don't decide to pursue anything any further, just for your peace of mind, talk with another lawyer to see if there is any way around this.

BIG HUGS.
