Default SSI question
ok folks time to pick your brains I want opinions and any examples are welcomed, I applied back in feb of 07 my hearing is this month... whoopiie doo

I have to pay back my disability pension if I win and I will win less 3o percent thanks to lawyers, and yet I am to make up the 30 % for my pension plus I will have to wait for 5 months to get health insurance

and I will not have life insurance through my work any more...

ok should I just blow off the meeting so it gets tossed out and I still get my disability pension same amount as sssi will pay each month plus i still have health and life insurance

I told binder and binder to drop this case a year and then some ago, because i knew this problem would arise in the end they refused to do so, blow off meeting sure seems like the best answer for me I just need some input from yall

Bummer...only thing is...Binder and Binder still want to get paid.

pros...you already have insurance including life
cons...you will be eligible for Medicare in two years, no life insurance, have to buy part D for prescription coverage

Pros...Binder and Binder will only get 5200.oo from your back pay, you have to pay back the LTD you received
Cons...your pension plan contract could be written so you don't have a choice unless it is medical retirement and could stop at any time. Seen it happen before.

Pros...I'm glad I don't have to decide what to do.

y concern is that if this is a lifetime disabilty you could not refile if there are no longer enough quaters. My son was in a similar situation on W/C and when he filed they found that he was not disabled in 2004, he is now...but he does not anylonger have any quarters.

So it was ruled against him.
IF you are goin to need SSDI in the future maybe you can work out with Binder and Binder that you will not show up unless they waive the attorneys 30%.....

Does your attorney have alternatives to straighten this out in your best interest NOT HIS?

The title of your post is SSI, you refer to SSI in the first sentence, you refer to SSSI in a later sentence, but every answer you are getting is referring to SSDI benefits and Medicare.

Since you are on LTD, I assume you have enough work credits in recent years to be insured for SSDI. So, I am going to assume your question is not about SSI but is about SSDI. Sorry that Social Security made the two different programs with such similar acronyms.

If this is really an SSI question, then I would give you a different answer.

I think you need to carefully read your LTD documents. You may be required to file and pursue the SSDI claim. Also, does your LTD have a termination date? I somehow doubt it is for life, but perhaps it is. SSDI lasts as long as you are disabled or you turn full retirement age, between 65 and 68.

How old are you? How close are you to age 62 and filing for Social Security early retirement as opposed to Social Security disability insurance? That might make a difference in your plan. You will take a permanent reduction in retirement benefits if you apply early, but you'll have them more years.

Your attorney can only take 25% of retroactive Social Security benefits with a cap of $5300. They can also charge you for costs. That should be in your Binder and Binder contract because it is mandated by SS law.

If the SSDI claim is approved, Medicare would be effective five full months after 24 months of eligibility. You filed in 2/07, but when did you stop working? When did you become too disabled to work? What is your date of onset? I somehow doubt you stopped work in 2/07, but I could be wrong about that. Eligibility CAN but MAY NOT go back to 12 months before filing BUT can also be a date later than filing. Depends on date of onset of disability.

How much is your Social Security estimated to be per month? More or less than your LTD? That's an important number to know.

You need to read all your documents again. You need a long conversation with your attorney before the hearing about all your concerns. Write down all your questions. I'd get answers from both a staffer and confirm them with the attorney.

most LTD benefits are only payable until age 65, which would be the avg retirement age.

My LTD makes up the difference between what I made and what SSDI actually pays. Check with your plan adm to get all the facts regarding your LTD plan.

its both actually for the time I was out of work while still officially employed and for long term, I am still waiting for the union to get back to me on the issue of payback but mine works same way till 65 or 68 and they cover what SS doesn't, and yes I do have to go so I shall be ok i shall persevere

your private LDI will normally have a waiver on Life Ins premiums as long as you are disabled you should have recieved a letter. If you didnt contact your employer and/or union rep. Your LDI may also have a company that is employed to do your SSDI so you dont need an Attorney and it doesnt cost you anything. Good luck I am on my second denial because of my age they dont want me on SSDI so the battle goes on. Good Luck
