Heart Dew's Court Date Delayed(5/19/09)

I got off the phone from my atty., and he shared with me that a delay for tomorrow's court date was in effect. The delay is because my PM doc had not responded to the WC atty. requests for a deposition.

Granted, the WC atty. had been requesting the wrong PM doc for weeks, until my atty. pointed out to him that they were attempting to depose the wrong PM Doc,lol!

I am to see my PM doc on 5/26/09, and at that time, it is expected that I will be placed on MMI. After that visit, I will contact my atty., and we will discuss the findings of my PM doc follow-up visit.

Hurry up and wait..,that is the mantra when dealing with WC. My atty. explained to me that the TTD will not be forgotten, as it will be placed in the main suit with everything else to be agreed upon, or fought for, in court.

WC Injury 03/24/07;Two Right Knee Surgeries on 5/22/07 and 01/16/08. Surgeons and Physical Therapists ignored my concerns of burning pain, swelling, and no improvement and getting worse. Diagnosed RSD/CRPS I/Sympathetically Mediated Pain Syndrome/Chronic Pain on 06/2008 by family doc;on 08/2008 and 12/2008 diagnosis confirmed by two WC PM Doctors: Both legs;hips; hands; and spine effected by this culprit. SSDI granted 01/2009.

I am so sorry you have to keep waiting for things to happen. It is so frustrating when you really don't have a lot of control over things happening. At least you are home again and can relax.

So sorry to hear that, Dew! I can't imagine how frustrated you must be right now! It really annoys me when doctors don't do somethign that they promised they would!

I hope that you wont have to wait too long and that you can get things sorted soon!

Have you double checked with your PM doc that he has the papers from your attorney? Since it is so important to you that these papers be executed by your doctor in a timely manner, it's probably not a bad idea to ensure that his office has ALL the paperwork, that they understand what has to be filled out and how to do it, when they need to have it done by, and where they should it. And then you might want to check and double check that it got done right and mailed on time (or pick it up, check it yourself for completeness, and then hand deliver it yourself).

I say this because lately my paperwork has been messed up when in transit between doctors' offices half a dozen times. Even when I have called to make sure that faxed records have properly been sent, it seems that my docs' admin assts can't manage to get my papers from one location to the other when they have a whole week to do it. Amazing! Or my file is there, but no one can find it...etc, etc.

BTW, when you receive both SSDi and WC, is there an offset of the smaller amount against the larger? Or are you entitled to receive both as an injured party? Just curious...

My PM doc needs to be deposed. The paperwork was finally sent to him,AFTER my atty. rec. copies of what was sent out...the WC atty. sent the deposition request out to the wrong PM! This is a time issue on my PM doc's part. Deposition is not a problem once it is scheduled in PM doc's schedule.

There is an offset from SSDI and WC. However, I am allowed to draw money from both WC and SSDI.

Hey Dew,
I am so sorry that they have done that to you. I kinda know what that is like. I was suppose to have a deposition around the first of this month at WC's request so I traveled to my attys office and at that point I found out that Wc attny had to cancel cuz he was stuck in Iowa City. So now it is rescheduled for June 19. I told the atty since i had to drive from my home to his office and then find out it was canceled then I want WC to pay for my trip to and from for this deposition. He said okay sounds reasonable. So if they do it again they will be paying me again. We can't afford to just run all over because that is what they want us to do so by golly they are going to start paying for that too.
I am praying for you Dew. Hang in there it is a long haul with WC. I settled out of court 2 years ago and WC renigged on what they made up and I agreed to so now we are going back and fighting them again. In total so far it has been 6 years and I am really getting tired but I know we have the case won we just have to get through all of the bumps along the way.
